Acceptable Use Policy
You are independently responsible for complying with all applicable laws in all of your actions related to your use of PayPal’s services, regardless of the purpose of the use. In addition, you must adhere to the terms of this Acceptable Use Policy.
Prohibited Activities
You may not use the PayPal service for activities that:
- violate any law, statute, ordinance or regulation
- relate to sales of (a) narcotics, steroids, certain controlled substances or other products that present a risk to consumer safety, (b) drug paraphernalia, (c) items that encourage, promote, facilitate or instruct others to engage in illegal activity, (d) items that promote hate, violence, racial intolerance, or the financial exploitation of a crime, (e) items that are considered obscene, (f) items that infringe or violate any copyright, trademark, right of publicity or privacy or any other proprietary right under the laws of any jurisdiction, (g) certain sexually oriented materials or services, (h) ammunition, firearms, or certain firearm parts or accessories, or (i) certain weapons or knives regulated under applicable law
- relate to transactions that (a) show the personal information of third parties in violation of applicable law, (b) support pyramid or ponzi schemes, matrix programs, other “get rich quick” schemes or certain multi-level marketing programs, (c) are associated with purchases of real property, annuities or lottery contracts, lay-away systems, off-shore banking or transactions to finance or refinance debts funded by a credit card, (d) are for the sale of certain items before the seller has control or possession of the item, (e) are by payment processors to collect payments on behalf of merchants, (f) are associated with the following Money Service Business Activities: the sale of traveler’s cheques or money orders, currency exchanges or cheque cashing, or (g) provide certain credit repair or debt settlement services
- involve the sales of products or services identified by government agencies to have a high likelihood of being fraudulent
- violate applicable laws or industry regulations regarding the sale of (a) tobacco products, or (b) prescription drugs and devices
- involve gambling, gaming and/or any other activity with an entry fee and a prize, including, but not limited to casino games, sports betting, horse or greyhound racing, lottery tickets, other ventures that facilitate gambling, games of skill (whether or not it is legally defined as a lottery) and sweepstakes unless the operator has obtained prior approval from PayPal and the operator and customers are located exclusively in jurisdictions where such activities are permitted by law.
Prohibited and Restricted Projects Policies
Make sure your listing follows these guidelines. If your Project doesn't, it may be removed, and you may be subject to a range of other actions, including restrictions on other existing and future Project you may list with the Service and the suspension of your account and User ID.Before listing your Project, please make sure it's allowed on FunderThunder and find out if there are specific rules and conditions on how it should be listed. See the list of prohibited and restricted items below. Promoters also need to make sure that any reward offerings must comply with our specific rules and conditions and all applicable laws, rules and regulations which may be promulgated by various governmental bodies with Federal, State or Local.
Understanding the rules
Here are some basic things to keep in mind when listing your Projects on FunderThunder:

You can list Projects to raise funds for charity if:
- You're soliciting on behalf of recognized, tax-deductible charitable organizations (for example, 501(c)(3) or equivalent status with the IRS).
- You receive advance written consent from the charitable organization for the solicitation—and include the following information in your listing:
- A readable photo or scanned image of the written consent. (This proof can't be a link to a website.) The letter must be on the charity’s letterhead and signed by one of the organization's officers
- The charity’s tax-deductibility status
- Your name or ThunderFunder user ID, dates of event or listings, and the donation amount (percentage of the final contribution total) you'll be donating if your Project reaches its goal.
Embargoed goods and prohibited countries – examples include items from Cuba
Various US agencies have restrictions in place that regulate or ban all trade with certain countries. ThunderFunder doesn't allow the pre-sale or offering or a contribution award of embargoed or restricted items from these countries. A complete list of countries is listed in the guidelines below.
Federal agencies also ban or regulate trade between people in the US and certain organizations, businesses, and individuals. ThunderFunder doesn't allow those organizations, businesses, or individuals to use our website.
Under US law, buying or selling certain items made in restricted countries may not be lawful, depending on the nature of the item, when it was manufactured, and when it left that specific country. Generally, items from restricted countries may be sold only if they’re considered to be informational, pre-embargo, or licensed.
Promoters willing to ship internationally, as well as Project Promoters of items made outside the US, should regularly review current information about which countries may be affected by sanctions enforced by the Office of Foreign Assets Control (OFAC), a division of the US Department of the Treasury. For more information about laws governing such trade, please see additional information below.
Make sure you follow these guidelines. If you don't, you may be subject to a range of actions, including limits of your privileges to list Projects and suspension of your account.
What are the guidelines?
The following information is meant as a general guideline to help you determine if a Project item is allowed to be listed on Thunder Funder or a product is allowed to be used as a contribution reward.

We also don't allow organizations, businesses, or individuals from these countries to have or register accounts while based in these countries. You can review the most up-to-date list of sanctions affecting countries, organizations, and individuals by visiting the Office of Foreign Assets Control website.

Prohibited services
FunderThunder doesn't allow Project Listings which provide for the sale of or offers of services that are illegal, sexual in nature, or that violate FunderThunder’s Terms of Use.

Stocks and other securities
The sale of stock or security interests is not allowed on FunderThunder. The U.S. Securities and Exchange Commission (SEC) regulates the sale of stocks and other security interests that represent a current investment ownership interest in an entity. They also regulate efforts by individuals to raise money or find investors for businesses.

What are the guidelines?

The goal of FunderThunder is assist people and entities raise capital for various projects and businesses through contributions made from third parties over the Internet. No Contribution awards may provide for any ownership interest in a particular project, including a share of the profits or evidence an intent to repay the Contribution back to the Contributor. Some business-related items are not "securities" and may be listed on FunderThunder. Here are some examples of items that can be sold:

Medical drugs and devices policy
FunderThunder does not allow Promoters to offer any drugs or medications that require a prescription from a licensed practitioner (such as a doctor, dentist, optometrist, or veterinarian) as a Contribution Reward. We also don't allow Promoters to offer any prescription medical devices as a Contribution Reward. However, FunderThunder does allow Promoters to receive Contributions for building and developing drugs, medications or medical devices which if necessary will receive any and all governmental approvals prior to sale to the general public.
Reporting policy violations
If you see a listing that violates FunderThunder policies, please report it by emailing us at Legal@ThunderFunder.com or by clicking Contact Us button located on most of our help pages. When a policy violation occurs, we email the Project Promoter and the Project Contributors to let them know that the Project listing has been removed from FunderThunder.
